Article 1 – Scope
These Terms of Sale govern all purchases made through labandeamiam.fr, operated by Halima AHAMADI, sole proprietor (Auto-Entrepreneur), based in Bordeaux, France.
By placing an order on this website, you agree to these Terms of Sale.
Article 2 – Orders
All orders placed on our website are subject to product availability and acceptance.
Once your order has been placed, you will receive an order confirmation by email.
As all products are made to order, please carefully review your order, including product options, personalization details, and shipping information before completing your purchase.
Once production has begun, orders cannot be modified or cancelled.
Article 3 – Prices
All prices are displayed in Euros (€) and include all applicable taxes (VAT where applicable).
La Bande à Miam reserves the right to modify its prices at any time. Products will always be invoiced at the price in effect when the order is placed.
Article 4 – Payment
Payment is due in full at the time of purchase.
Payments are processed securely through the payment methods offered during checkout.
Your order will only enter production once payment has been successfully received.
Article 5 – Production and Shipping
Each item is made to order.
Estimated production time is displayed on the website and may vary depending on order volume.
Orders are shipped from Bordeaux, France, using carriers such as La Poste (Colissimo) or Mondial Relay.
Delivery times are estimates only and cannot be guaranteed. La Bande à Miam cannot be held responsible for delays caused by the carrier or events beyond our control.
Customers are responsible for providing a complete and accurate shipping address.
Article 6 – Personalized Products
Our products are personalized and manufactured specifically according to the customer’s specifications.
Please carefully verify all personalization details (including spelling, names, text, colors, and size) before placing your order.
La Bande à Miam cannot be held responsible for errors submitted by the customer.
Article 7 – Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code and Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized.
As all products sold by La Bande à Miam are made to order and personalized, they cannot be cancelled, returned, or refunded once production has started, except in the event of a manufacturing defect, damage during transport, or an error on our part.
Article 8 – Returns and Refunds
Returns and refunds are only accepted if:
- the item is defective;
- the item arrives damaged;
- the wrong product has been sent due to our error.
If you encounter any of these issues, please contact us within 48 hours of delivery at contact@labandeamiam.fr, including your order number and clear photographs of the issue.
If your claim is approved, we will offer a replacement or a full refund.
Article 9 – Governing Law and Disputes
These Terms of Sale are governed by French law.
In the event of a dispute, both parties agree to seek an amicable solution before taking legal action.
If no agreement can be reached, the dispute shall fall under the jurisdiction of the competent French courts.
